Some progress made, commissioners report
By Chris Meyers Staff writer Despite some progress made in recent weeks with a utility company which says Whitley County owes nearly $2,000 for a contract cancellation, the issue is far from resolved. Whitley County Commissioner Tom Rethlake said Monday that he has spent hours on the phone with Just Energy to try to resolve the matter, but to little avail. At issue is whether the county should pay $1,800 to Just Energy for a natural gas contract, which was canceled at the end of November. Under the terms of the cancellation agreement, the county had to give five days notice to avoid extra fees. The county coordinator faxed a notice of cancellation to Just Energy within the five-day window — a fact neither side disputes — but Just Energy said since an account number was not included with the fax, the account was not canceled as ordered. Rethlake said that after several transfers while on the phone with Just Energy, a representative said the amount owed could be reduced by half. That is still far from the zero amount the county is willing to pay. “It’s a merry-go-round,” Rethlake said of trying to get an answer from the company by the phone. As talks continue between the commissioners and Just Energy, county attorney Dan Sigler has filed a complaint with the Indiana Utility Regulatory Commission over what the county feels is a deceptive business practice. Rethlake said he hoped to hear from Just Energy sometime today about a resolution to the issue.
