COLUMBIA CITY — An apologetic and tearful South Whitley man received a six-year sentence for sexual misconduct with a minor Monday.
Timothy J. Swihart, 19, will serve two of those six years in Whitley County Jail, with the other four years of the sentence suspended and to be served on probation.
Swihart pleaded guilty as part of an agreement last month.
Part of that arrangement was capping his term of incarceration at four years.
In his statement, Swihart’s attorney, Jeff Arnold, requested a local sentence.
“It would do more harm than good to send him to the DOC (Department of Corrections),” Arnold said, pointing out this incident was Swihart’s first conviction.
